At SPX, I got a chance to talk with Chris Oarr of the mighty, mighty CBLDF. He caught me up on the case of the West Virginia man who had been charged with distributing obscene material to minors... i.e., two issues of ElfQuest, one of which I wrote.

He's a free man now.

In fact, if memory serves, Chris described it as being "dismissed", which is the legalistic term for the case being laughed out of court.

So I guess I can't hold my head up high in literary circles. The government is not coming down on my work.

But the good guys won this one.

Yay! Since I have also recently drawn an ElfQuest birth scene, this makes me happy. I don't have to worry about some narrow-minded wack jobs arresting me.

On the other hand, they did manage to drag him into court on it, and made him pay a lawyer, etc. etc. And refresh my memory, please -- did they actually manage to put him behind bars on it, even for one minute?

Baseless criminal charges remain an excellent means of harassment for those inclined toward ruthlessness in dealing with former loved ones.

And the child remains an unfortunate victim.

I can't find the Peter David article at the moment, but if memory serves he spent a night in jail... but in the hallway rather than a cell, due to overcrowding. I suppose that technically he spent the night *in front* of bars, rather than behind them.

And yes, I do think it's sad how the system was used against this guy.

(As for the legal costs, I believe those were largely or totally carried by the CBLDF.)

It's a good article, a perfect follow-up to the piece that broke the news in TCJ #215.

From a combo of the TCJ/CBG articles, I understand that he wasn't read his rights at the time.
